The Fair Work System overview



  • certain minimum standards set out by the National Employment Standards (NES), and 
  • any applicable modern award or enterprise agreement under the Fair Work Act

  • requests for flexible working arrangements 
  • offers and requests to convert from casual to permanent employment 
  • parental leave and related entitlements 
  • annual leave 
  • personal/carer's leave, compassionate leave and family and domestic violence leave 
  • community service leave 
  • long service leave 
  • public holidays 
  • superannuation contributions
  • notice of termination and redundancy pay, and 
  • Information statements (Fair Work Information Statement, Casual Employment Information Statement, and Fixed Term Contract Information Statement)

  • employee entitlements under the Fair Work Act, including the NES
  • industrial instruments, and 
  • general protections and 'adverse action', including workplace rights, industrial activities, sham contracting arrangements, sexual harassment, discrimination, and the right to disconnect
